Terms and conditions for consumers

1. Introduction

1.1 Doctors in Denmark ("The Platform") provides healthcare services in the category of general medical care ("Consultation").

1.2 The Consultations are sold and performed by practicing medical specialists affiliated with the Platform (the "Doctor") as independent entrepreneurs at their own expense and risk. The Doctor is not employed by the Platform and the Consultation is therefore not provided by the Platform. The Platform does not provide Consultations and is not responsible for them.

1.3 All Doctors specialize in general medicine with authorization from the Danish Patient Safety Authority and they work in clinics with a provider number to treat patients for the public sector.

2. Ordering and purchasing

2.1 You book an appointment for a Consultation on www.lægernedanmark.dk (the "Website"). You will receive a confirmation on the e-mail address you have provided.

2.2 You purchase the Consultation from the Doctor by physical attendance at the Doctor's address or as a video consultation by appointment. 

2.3 It is a prerequisite for performing the Consultation that you give the Doctor your consent to receive the healthcare service. If you are under 15 years old, you must be accompanied by a parent or guardian. 

2.4 If you are unable to attend at the agreed time, you must book a new time or cancel your appointment. Cancellation must be made on the Website. For more information on no-show fees, see below under the section No-show, cancellation and relocation.

3. Consultation

3.1 The consultation is carried out on the date and time you have booked.

3.2 A Consultation consists of a conversation, possibly supplemented by a physical examination for the purpose of investigation and a course of treatment, including, for example, diagnosis, prescription of medicines and/or referral to specialist medical care. 

3.3 The consultation lasts 15-60 minutes depending on the reason for the request.

3.4 The doctor is responsible for ensuring that the Consultation complies with the medical requirements and guidelines in the area, record keeping, reporting, entry in FMK, etc.

3.5 At the Consultation, the Doctor assesses whether there is a medical need for additional services, e.g. ECG, throat swab, blood and tissue samples, etc.

4. Prices

4.1 The price of a Consultation depends on its duration and whether it takes place in person or by video conference. You agree any Additional Services directly with the Doctor during the Consultation. 

4.2 Prices for Consultations and most Additional Services are available on the Website.

4.3 Consultations and Additional Services are, with certain exceptions, VAT exempt. Any VAT will be disclosed in connection with the purchase.

5. Payment

5.1 The Platform and the Doctor cooperate with Easypay to maintain a secure payment solution. When you confirm your appointment, we will use the payment card details you have provided in connection with the appointment to reserve the Price for your Consultation in your account, see section 4.1.

5.2 At the end of the Consultation, you pay by having the Platform, on behalf of the Doctor, deduct the reserved amount from your account. You will subsequently receive a receipt by email.

5.3 You pay any Additional Services in cash at the Doctor's office in connection with the Consultation. You can pay by credit card or MobilePay. You will receive the receipt for your purchase of Additional Services directly from the Doctor by email or in paper format.

5.4 Sections 5.1 - 5.3 do not apply if you book time as an employee or covered under your employer's or insurance company's agreement with the Platform regarding payment for Consultations, additional services and any Cancellation Fee.

5.5 If you do not show up or wish to cancel or reschedule your appointment later than 24 hours before the agreed time, the Doctor is entitled to a Cancellation Fee. See Cancellation Fee below under the section No-show, cancellation and rescheduling.

6. No-show, cancellation and relocation

6.1 Your right of withdrawal lapses 24 hours before the agreed time for the Consultation, as the Doctor prepares your Consultation from this time, cf. section 18(2)(2)(2) of the Danish Consumer Contracts Act. For example, if you have booked an appointment at 18:00, you must cancel or reschedule your appointment no later than 18:00 the day before. The Doctor is entitled to charge a fee corresponding to the reserved amount, cf. section 5.1 ("Cancellation Fee"), if you do not show up or wish to cancel or reschedule your appointment later than 24 hours before the agreed time for Consultation. You agree that the Platform on behalf of the Doctor may deduct the Cancellation Fee in connection with your appointment booking. 

7. Liability and responsibility

7.1 The platform makes reservations for printing and pricing errors.

7.2. The Platform is not responsible for any breakdown or failure of access to the Website, breakdown in power supply or internet connection, vandalism to the system (both physical as well as computer viruses and hacking), misuse of personal data or other conditions and circumstances beyond their control.

7.3 The Platform does not provide Consultations and is not responsible for them.

7.4. The Platform can only be held liable for damage or loss directly attributable to the use of the Platform, including the provision of the Consultation. The Platform is not liable for operating losses, loss of profit or other indirect or consequential loss. 

7.5 The Doctor is liable for the Consultation in accordance with the Danish Act on Complaints and Liability for Damages in the Health Care System and the general rules of Danish law. 

7.6. For damages arising from a Consultation, please refer to Patienterstatningen www.pebl.dk.

8. Unintentional incidents

9. Complaints

9.4 If you would like further guidance on your complaint options, you are welcome to contact the Platform.

10 Force majeure

10.1. The Platform does not accept any liability for non-delivery or delayed delivery of services due to force majeure or other unforeseen obstacles or difficulties beyond the Platform's control. Force majeure includes, for example, natural disasters, extreme weather and weather conditions, war, terrorism, epidemics, riots and civil unrest, government intervention, fire, strikes, lockouts, blockades and other labor disputes, as well as non-delivery or delayed delivery of services from the Platform's usual subcontractors due to force majeure. 

11. Personal data

11.1 The Platform processes your personal data in accordance with applicable law as further described in the Platform's privacy policy https://laegernedanmark.dk/privatlivspolitik/

12. Choice of law and jurisdiction

12.1. The Platform and the Processes are in all respects subject to Danish law, and any disputes may only be brought before Danish courts.
